Kmerflix Terms and Conditions (English)

These Terms and Conditions ("Terms") govern your access to and use of the Kmerflix service. By using Kmerflix, you agree to these Terms.

Kmerflix is an offline entertainment subscription service. We curate video content and deliver it weekly on USB drives for offline viewing.

1. Eligibility and accounts

To use Kmerflix, you must be able to form a binding agreement under applicable law.

You access Kmerflix by authenticating through supported messaging channels (such as WhatsApp or Telegram) and by completing subscription details. You are responsible for keeping access to your messaging account secure.

2. Service description

Kmerflix provides:

  • weekly USB delivery of curated video packs,
  • personalization based on your preferences, and
  • subscription-based billing.

Service availability may be limited by city, delivery zones, and operational capacity.

3. Registration fee and subscription billing

Kmerflix uses a two-phase activation:

  • A registration fee is due at the first delivery.
  • Monthly billing starts one month after the first delivery.

Unless stated otherwise in a specific offer, your subscription continues until it is canceled.

4. Deliveries and logistics

Deliveries are scheduled using the preferences you provide, including your city, district/quarter, delivery spot, and preferred delivery day.

You agree to:

  • provide accurate delivery details,
  • be reasonably reachable at the delivery time and location, and
  • update your delivery details when they change.

We may reschedule deliveries due to weather, safety, availability, or other operational constraints.

5. Preferences and personalization

You can configure your weekly pack through your preferences. These preferences may include content types, categories, and quality preferences.

You are responsible for the preferences you select, including any adult-content preferences you enable.

6. Messaging communities and communications

Kmerflix may offer optional messaging communities. Joining these communities is optional and controlled by explicit opt-in settings.

We may send service-related communications necessary to operate the subscription, such as delivery coordination, billing reminders, and support responses.

7. Payments

You agree to pay all applicable fees for the service, including registration fees and ongoing subscription fees.

Payments may be tracked through payment records that include status, due dates, references, and related operational metadata. If a payment is due and remains unpaid, we may pause or limit service until the account is brought current.

8. USB handling, loss, and damage

USB drives are physical delivery media used to provide the service.

You agree to:

  • handle USB drives with reasonable care,
  • return, exchange, or make them available as instructed for ongoing weekly service (if your plan requires rotation), and
  • report loss or damage promptly.

Kmerflix may charge reasonable replacement or recovery fees in cases of repeated loss, damage, or non-return where applicable.

9. Acceptable use

You agree not to:

  • misuse the service,
  • attempt to interfere with delivery operations, billing, or platform security,
  • use the service for unlawful purposes, or
  • attempt to access accounts or data that are not yours.

We may suspend or terminate access if we reasonably believe you have violated these Terms or created risk for the service, delivery teams, or other users.

10. Content and availability disclaimers

Kmerflix curates content based on availability and operational constraints. We do not guarantee that:

  • specific titles will always be available,
  • requested titles will always be included, or
  • every delivery will contain the same number or type of items.

Where possible, we will make reasonable efforts to honor preferences and requests.

11. Changes to the service

We may modify, pause, or discontinue parts of the service to improve operations, address safety concerns, comply with law, or manage availability.

We may also update subscription features, delivery policies, and eligibility zones over time.

12. Cancellation and pauses

You may request cancellation or pauses through the support channels we provide.

Cancellation or pauses do not automatically erase outstanding balances. Any due or unpaid amounts remain payable.

13. Privacy

Your use of Kmerflix is also governed by our Privacy Policy. Please review it to understand what we collect and how we handle personal data.

14. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law:

  • the service is provided on an "as is" and "as available" basis, and
  • Kmerflix disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.

Kmerflix will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, revenues, goodwill, or data, arising from or related to the service.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Indemnity

You agree to indemnify and hold harmless Kmerflix and its operators from claims, liabilities, and expenses arising out of your misuse of the service, your violation of these Terms, or your violation of applicable law.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the service after changes become effective means you accept the updated Terms.
